The WTO dispute settlement system is currently in crisis. Its highest court, the Appellate Body (AB), has been non-functional since December 2019 because the United States has vetoed the appointment of new judges. The absence of the appeal stage also undermines\u202fdispute\u202fsettlement\u202fat the\u202fWTO&#8217;s first instance, the panels, whose reports can be appealed into the void and are left in limbo. As a result, Members\u2019\u202fWTO\u202fcommitments are left unenforceable.  <\/p>\n\n<p><span class=\"TextRun SCXW110500742 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"none\"><span class=\"NormalTextRun SCXW110500742 BCX0\">At the Geneva <\/span><\/span><a class=\"Hyperlink SCXW110500742 BCX0\" href=\"https:\/\/docs.wto.org\/dol2fe\/Pages\/SS\/directdoc.aspx?filename=q:\/WT\/MIN22\/24.pdf&amp;Open=True\" target=\"_blank\" rel=\"noreferrer noopener\"><span class=\"TextRun Underlined SCXW110500742 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"none\"><span class=\"NormalTextRun SCXW110500742 BCX0\" data-ccp-charstyle=\"Hyperlink\">Ministerial Declaration of June 2022<\/span><\/span><\/a><span class=\"TextRun SCXW110500742 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"none\"><span class=\"NormalTextRun SCXW110500742 BCX0\">,\u202fWTO Members committed themselves to\u202fwork\u202ftowards re-establishing a &#8220;fully and well-functioning\u202fdispute settlement\u202fsystem&#8221; that is &#8220;accessible\u202fto\u202fall Members&#8221; by 2024.\u202fYet, solutions to the crisis remain elusive.<\/span><\/span><span class=\"EOP SCXW110500742 BCX0\" data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n\n<p>The Ottawa\u202fsymposium sought\u202fto\u202fsupport the efforts of reform by identifying innovative approaches\u202fto\u202frevitalize the\u202fWTO\u202fdispute\u202fsettlement\u202fsystem. The participants included academics, practitioners, diplomates as well as former trade negotiators, panellists, Appellate Body members and WTO officials. Tellier Chair on Business and Public Policy<\/a>, <a href=\"https:\/\/www.bennettjones.com\/\" target=\"_blank\" rel=\"noopener\">Bennett Jones<\/a>, the <a href=\"https:\/\/www.ccil-ccdi.ca\/\" target=\"_blank\" rel=\"noopener\">Canadian Council on International Law<\/a> and the <a href=\"https:\/\/www.uottawa.ca\/faculty-law\/\" target=\"_blank\" rel=\"noopener\">University of Ottawa, Faculty of Law<\/a>.<\/p>\n\n<p>The deliberations focused on three main questions:  <\/p>\n\n<ol class=\"wp-block-list\" start=\"1\">\n<li><strong>how can WTO members reform the adjudicatory dispute settlement system?\u00a0<\/strong><\/li>\n<\/ol>\n\n<ol class=\"wp-block-list\" start=\"2\">\n<li><strong>how can the deliberative function of the WTO be enhanced?\u00a0<\/strong><\/li>\n<\/ol>\n\n<ol class=\"wp-block-list\" start=\"3\">\n<li><strong>how can alternative dispute resolution mechanisms be used to resolve trade disputes?\u00a0<\/strong><\/li>\n<\/ol>\n\n<p><span class=\"TextRun SCXW123609286 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"none\"><span class=\"NormalTextRun SCXW123609286 BCX0\">The conference resulted in a <\/span><\/span><a class=\"Hyperlink SCXW123609286 BCX0\" href=\"https:\/\/www.uottawa.ca\/faculty-law\/sites\/g\/files\/bhrskd406\/files\/2023-08\/Ottawa_Rethinking%20WTO%20Dispute%20Settlement_1Aug2023.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><span class=\"TextRun Underlined SCXW123609286 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"none\"><span class=\"NormalTextRun SCXW123609286 BCX0\" data-ccp-charstyle=\"Hyperlink\">Rethink WTO Dispute Settlement Report<\/span><\/span><\/a> <span class=\"TextRun SCXW123609286 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"none\"><span class=\"NormalTextRun SCXW123609286 BCX0\">to provide policymakers with a wide range of ideas and perspectives on the potential routes of the WTO reform. Rather than formulating specific recommendations, the Report <\/span><span class=\"NormalTextRun SCXW123609286 BCX0\">seeks<\/span><span class=\"NormalTextRun SCXW123609286 BCX0\"> to highlight and organize ideas circulating in academia and practice. The Report comprehensive described the wide range of current challenges facing WTO dispute settlement (including procedural, substantive, systematic, political and equity challenges), mapped existing reform ideas and provided structured reflections on the potential trade-offs for further reform.\u202f<\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In May 2023, a diverse group of over forty World Trade Organization (WTO) experts gathered at the University of Ottawa to address the challenges plaguing the WTO dispute settlement system.
