In our new Carbon Pricing Series, we learn about their experiences and the arguments they made on behalf of their clients. <\/p>\n\n<p>In this video, we meet Joshua Ginsberg, Director of the University of Ottawa&#8217;s EcoJustice Environmental Law Clinic, who represented the David Suzuki Foundation before the Court. He argued that climate change, and specifically getting greenhouse gas emissions under control, constitutes not only a matter of national concern, but represents a true national emergency. Climate change, he contends, needs to be federally regulated within 10 years to avoid environmental disaster.   <\/p>\n\n<p><span class=\"TextRun SCXW121995393 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"none\"><span class=\"NormalTextRun SCXW121995393 BCX0\">The <\/span><\/span><em><span class=\"TextRun SCXW121995393 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"none\"><span class=\"NormalTextRun SCXW121995393 BCX0\">Greenhouse Gas Pollution Pricing Act<\/span><\/span><\/em><span class=\"TextRun SCXW121995393 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"none\"><span class=\"NormalTextRun SCXW121995393 BCX0\"> is an Act of the Parliament of Canada that sets a minimum national standard on greenhouse gas pricing to reduce emissions in Canada and fulfil<\/span><span class=\"NormalTextRun SCXW121995393 BCX0\">l<\/span><span class=\"NormalTextRun SCXW121995393 BCX0\"> the country\u2019s commitments under the 2015 Paris Agreement. Some Canadian provinces challenged the constitutionality of that Act, taking the case to the Supreme Court of Canada based on an argument that it was beyond the jurisdiction of the federal government to impose a national standard on greenhouse emissions because natural resource regulation under the Constitution falls under provincial jurisdiction.<\/span><\/span><span class=\"EOP SCXW121995393 BCX0\" data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n\n<p><span class=\"TextRun SCXW200900564 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"none\"><span class=\"NormalTextRun SCXW200900564 BCX0\">On March 25, 2021, the Supreme Court of Canada, in the landmark decision <\/span><\/span><span class=\"TextRun SCXW200900564 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"none\"><span class=\"NormalTextRun SCXW200900564 BCX0\">References re Greenhouse Gas Pollution Pricing Act, <\/span><\/span><span class=\"TextRun SCXW200900564 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"none\"><span class=\"NormalTextRun SCXW200900564 BCX0\">ruled that the <\/span><\/span><em><span class=\"TextRun SCXW200900564 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"none\"><span class=\"NormalTextRun SCXW200900564 BCX0\">Greenhouse Gas Pollution Pricing Act<\/span><\/span><\/em><span class=\"TextRun SCXW200900564 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"none\"><span class=\"NormalTextRun SCXW200900564 BCX0\"> is a valid exercise of federal powers.
