As an essential part of <\/span>any<\/span> free and <\/span>democratic<\/span> society, <\/span>freedom<\/span> of expression<\/span> regularly<\/span> finds<\/span> itself<\/span> in the spotlight. As the case of <\/span><\/span>Ward v. <\/span>Quebec<\/span><\/span> (Commission des droits de la personne et des droits de la jeunesse) <\/span>demonstrates<\/span>, <\/span>when<\/span> this<\/span> freedom<\/span> runs up <\/span>against<\/span> another<\/span> fundamental<\/span> right<\/span>, <\/span>such<\/span> as the right to <\/span>safeguard<\/span> one’s<\/span> dignity<\/span>, <\/span>honour<\/span> and <\/span>reputation<\/span>, <\/span>the <\/span>resulting<\/span> conflict<\/span> of <\/span>rights<\/span> gives<\/span> rise<\/span> to <\/span>captivating<\/span>, but <\/span>also<\/span> divisive, <\/span>legal<\/span>, <\/span>legislative<\/span> and social <\/span>debates<\/span>.\u00a0\u00a0<\/span><\/span>\u00a0<\/span><\/p>\n\n

In this video, students from the Civil Law Section of the University of Ottawa’s Faculty of Law explore the clash between freedom of expression and the right to dignity in the context of the high-profile Ward decision. They meet with professor and lawyer Ghislain Otis, a specialist in constitutional law and human rights, to analyze the opposing legal concepts in this decision and the resulting impacts. They also speak with Montreal-area comedian David larusso about the impact of this decision on the stand-up comedy community. <\/p>\n\n
