{"id":94293,"date":"2022-06-03T10:44:19","date_gmt":"2022-06-03T14:44:19","guid":{"rendered":"https:\/\/jurivision.ca\/?p=94293"},"modified":"2025-04-09T17:16:14","modified_gmt":"2025-04-09T21:16:14","slug":"the-iccs-jurisdiction-over-international-crimes","status":"publish","type":"post","link":"https:\/\/jurivision.ca\/en\/the-iccs-jurisdiction-over-international-crimes\/","title":{"rendered":"The International Criminal Court&#8217;s Jurisdiction Over International Crimes"},"content":{"rendered":"\n<p><span class=\"NormalTextRun SCXW230454170 BCX0\">The International Criminal Court (ICC) <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">is<\/span><span class=\"NormalTextRun SCXW230454170 BCX0\"> the first permanent court <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">charged<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">with<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">bringing<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">those<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">who<\/span><span class=\"NormalTextRun SCXW230454170 BCX0\"> have <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">committed<\/span><span class=\"NormalTextRun SCXW230454170 BCX0\"> crimes of the <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">most<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">serious<\/span><span class=\"NormalTextRun SCXW230454170 BCX0\"> nature and magnitude \u2013 crimes for <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">which<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">impunity<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">is<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">unacceptable<\/span><span class=\"NormalTextRun SCXW230454170 BCX0\"> \u2013 <\/span><span class=\"NormalTextRun SCXW230454170 BCX0\">to justice<\/span><span class=\"NormalTextRun SCXW230454170 BCX0\">. The <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">Court&#8217;s<\/span><span class=\"NormalTextRun SCXW230454170 BCX0\">&nbsp;<\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">jurisdiction<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">includes<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">war<\/span><span class=\"NormalTextRun SCXW230454170 BCX0\"> crimes, crimes <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">against<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">humanity<\/span><span class=\"NormalTextRun SCXW230454170 BCX0\">, <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">genocide<\/span><span class=\"NormalTextRun SCXW230454170 BCX0\"> and crimes of <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">aggression<\/span><span class=\"NormalTextRun SCXW230454170 BCX0\">. <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">Established<\/span><span class=\"NormalTextRun SCXW230454170 BCX0\"> by the Rome <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">Statute<\/span><span class=\"NormalTextRun SCXW230454170 BCX0\">,<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">adopted<\/span><span class=\"NormalTextRun SCXW230454170 BCX0\"> in July 1998, the Court <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">entered<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">into<\/span><span class=\"NormalTextRun SCXW230454170 BCX0\"> force on July 1, 2002 and <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">therefore<\/span><span class=\"NormalTextRun SCXW230454170 BCX0\"> has <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">jurisdiction<\/span><span class=\"NormalTextRun SCXW230454170 BCX0\"> over crimes <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">committed<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">from<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">that<\/span><span class=\"NormalTextRun SCXW230454170 BCX0\"> date <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW230454170 BCX0\">forward<\/span><span class=\"NormalTextRun SCXW230454170 BCX0\">.<\/span><\/p>\n\n\n\n<p>In order for the ICC to exercise its jurisdiction, the states concerned must have signed and ratified the Rome Statute. In those cases, the ICC can deal with crimes committed on the territory of a State Party or by nationals of a State Party. It is also able to deal with crimes within its material jurisdiction if a state, even one not party to the Rome Statute, has, through a declaration to the Court, consented to the Court&#8217;s jurisdiction over the crimes committed. This is the current situation with the war in Ukraine. In 2014 and 2015, Kiev accepted by declaration the jurisdiction of the ICC following the crimes committed by Russia in Crimea and the Donbass region. The ICC can deal with any crime falling within its jurisdiction regardless of whether or not the states concerned have accepted it, as long as it is referred by the Security Council under Chapter VII of the UN Charter, as part of the UN\u2019s peacekeeping mission.
