{"id":93375,"date":"2022-04-01T15:09:22","date_gmt":"2022-04-01T19:09:22","guid":{"rendered":"https:\/\/jurivision.ca\/the-crime-of-aggression-in-international-criminal-law\/"},"modified":"2023-05-17T15:14:44","modified_gmt":"2023-05-17T19:14:44","slug":"the-crime-of-aggression-in-international-criminal-law","status":"publish","type":"post","link":"https:\/\/jurivision.ca\/en\/the-crime-of-aggression-in-international-criminal-law\/","title":{"rendered":"The Crime of Aggression in International Criminal Law"},"content":{"rendered":"\n<p>Since the onslaught of the Russian army into Ukraine on February 24, the Kremlin&#8217;s refusal to use certain words \u2013 notably its use of the term &#8220;special military operation&#8221; rather than &#8220;war&#8221; or &#8220;invasion&#8221; \u2013 forces us to reconsider how to justly classify, in terms of international criminal law, the acts committed in the course of this conflict, with a view to de-instrumentalizing the political rhetoric and restoring the real legal contours to the violence being committed.    <\/p>\n\n\n\n<p>The Rome Statute provides for criminal jurisdiction at the international level over individuals who commit any crime that affects the international community as a whole. It punishes violations of international humanitarian law and defines the most serious core international crimes: the <strong>crime of aggression<\/strong>, <strong>war crimes<\/strong>, <strong>crimes against humanity<\/strong> and the <strong>crime of genocide<\/strong>.<\/p>\n\n\n\n<p>Professor Muriel Paradelle examines the elements to be taken into account in order to qualify as a crime of aggression under international law in the context of the conflict in Ukraine.
