The low rate of reporting and conviction for crimes of sexual assault is a burning issue today. The Canadian criminal justice system requires the Crown to prove a crime of sexual assault “beyond a reasonable doubt” for conviction. In recent years, particularly since the Rozon<\/em> Case<\/a>, this high standard of proof has been questioned in the media.<\/p>\n\n\n\n

In this video, law students meet with Professor Jennifer Quaid to better understand the primary difficulties encountered by victims of sexual assault and the limitations of the Canadian criminal justice system in dealing with these cases. They expose the complexity of the judicial process and the disadvantageous position of victims with respect to the principle of presumption of innocence in criminal law, as well as the prejudices regarding evidence and witness credibility. These barriers are real and the establishment of a specialized court, as recommended by the Expert Committee on Victim Support for Sexual Assault and Domestic Violence<\/em>, may be one way to bring about structural changes to the justice system for victims of sexual assault.<\/p>\n\n\n\n
